Katie Holmes Files for Divorce From Tom Cruise; Seeks Sole Custody of Daughter Suri

Katie Holmes has filed for divorce from husband Tom Cruise (49) after five years of marriage. The 33-year-old actress has lodged papers in New York blaming “irreconcilable differences” for ending her marriage to the Hollywood heart-throb and have filed for sole custody of their daughter Suri, six. This will be Tom Cruise’s third divorce after previously getting married and divorce from Mimi Rogers and Nicole Kidman, both actresses too. Tom and Nicole adopted two children, Isabella Jane and Connor Antony, during their ten year marriage.

Katie Holmes married Tom Cruise in November 2006 with a prenuptial agreement, for each year the couple stay married, the Dawson's Creek actress collects $3million - to a maximum of $33 million after 11 years - as well as their palatial home in California. If their marriage had lasted more than 11 years, Holmes would have received half of Cruises’s reportedly $250 million fortune.

After filing for divorce less than six years later, Katie should only be entitled to $15 million as well as the couple's $35 million Beverly Hills Mansion. Sources reveal the 33-year-old will be asking for a 'suitable amount' in child support, as well as a division of property, though no mention was made of the prenuptial agreement in divorce papers.

Tom Cruise is currently in Iceland shooting for the sci-fi flick 'Oblivion in Iceland'. A spokesperson for Cruise said, 'Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children.'

A bitter custody battle is set to break out between Tom and Katie over their young daughter, Suri.
